These terms govern the promotional prize draw “Win a DNP QW410 printer” organised by Photobooth Premium. By taking part, you accept them. The draw only takes place if 10,000 valid entries are reached (clause 7).
1. Organiser
The prize draw is organised by the company that owns photoboothpremium.com, whose identification details (company name, tax ID and registered address) are set out in the Legal Notice. For any question about the prize draw, write to [email protected].
The prize draw is announced on photoboothpremium.com and in the Organiser’s emails. It is not sponsored, endorsed or administered by DNP or by any social network.
2. Free Entry
Entry is free and no purchase is necessary, now or at any later time. Winning does not oblige you to buy any product or service either.
3. Who Can Enter
Individuals aged 18 or over, whether or not acting in the course of a business or profession, who are resident in one of these countries: Spain, France, Germany, Austria, Switzerland, Belgium, United Kingdom and Ireland.
Residents of Portugal, Italy and the Netherlands are excluded from the prize draw. If you subscribe to the newsletter from one of those countries or from any other country not listed above, you will be added to the mailing list but will not take part in the prize draw. The form tells you so before you choose your country.
Employees of the Organiser or of the companies in its group, and their relatives up to the second degree, are not eligible.
4. How to Enter
Simply subscribe to the Photobooth Premium newsletter using the form on the website (the giveaway window or the footer block), entering your name, email address and telephone number and ticking the consent box.
- One entry per person, identified by email address. Duplicate entries count as one.
- Entries with false or incomplete details, entries made on behalf of third parties and entries generated by automated means will be disqualified.
- Unsubscribing from the newsletter does not cancel your entry: your email address is kept solely to run the prize draw.
5. Entry Period
You can enter from the publication of these terms until 31 March 2027 at 23:59 (Spanish mainland time). Subscriptions received after that date are added to the newsletter but not to this prize draw. This period may only be extended in the case provided for in clause 7.
6. Prize
There is a single prize, consisting of:
- A DNP QW410 dye-sublimation photo printer, new and covered by the manufacturer’s warranty.
- A box of DNP paper for the QW410 (two rolls, 300 prints at 10x15 cm).
The reference value of the prize is its public price on photoboothpremium.com: €777 + VAT.
- Delivery to the winner’s address within the territory of the prize draw is paid by the Organiser, including, in Switzerland and the United Kingdom, customs duties and import VAT.
- The prize is personal and non-transferable and cannot be exchanged for cash or for any other product.
- If, at the time of delivery, the model has been discontinued or is out of stock, it will be replaced with a DNP printer of equal or higher specification.
7. Draw and Selection of the Winner
The draw will take place on 15 April 2027 among all valid entries, using a computerised random selection system. One winner and two reserves are drawn in order at the same time. The Organiser keeps an internal record of the draw, which any entrant may consult on request. The draw is not held before a notary, as this is not required for a promotional prize draw.
Minimum number of entries. The draw only takes place if at least 10,000 valid entries have been received by the closing date. If that figure is not reached, the Organiser may extend the entry period once, by up to six months, and set a new draw date. If the figure is still not reached, or if the period is not extended, the prize draw is declared void: no draw is held and no prize is awarded. Any extension or void draw is announced on the website and in the newsletter before 15 April 2027.
8. Notification and Acceptance
The winner will be notified by email, at the address used to enter, within seven calendar days of the draw. The winner then has ten calendar days to accept the prize and provide delivery details.
If the winner does not reply within that period, declines the prize or does not comply with these terms, the prize passes to the first reserve and then to the second, following the same procedure and time limits. If neither accepts it, a new draw will be held among the remaining valid entries.
The Organiser is not responsible for notifications that fail to arrive because of a mistyped email address, a full inbox or spam filters.
9. Delivery
The prize will be delivered to the address given by the winner within the territory of the prize draw, no later than thirty calendar days after acceptance.
10. Tax
Under Spanish law, the prize is a capital gain received in kind. As its value exceeds €300, the Organiser will calculate and pay the corresponding Spanish withholding payment on account (ingreso a cuenta) at its own expense, without passing it on to the winner, and will provide the winner with the relevant certificate. The winner is responsible for declaring the prize in their own tax return.
If the winner is not resident in Spain, their taxation will be governed by the laws of their country of residence and, where applicable, by the Spanish Non-Resident Income Tax rules and the relevant double taxation treaties.
11. Publication of the Result
By accepting the prize, the winner authorises the publication of their first name, the initial of their surname and their country on the website and in the newsletter, solely to announce the result and without payment. The winner may object by writing to [email protected], without this affecting the prize.
12. Data Protection
The Organiser processes entry data (name, email address, telephone number and, if provided, country) for two purposes: running the prize draw and sending the monthly newsletter to which entry subscribes you. The legal basis is consent, given by ticking the box on the form.
- Prize draw data are kept until the draw is concluded and thereafter for the periods required by law. Newsletter data are kept until you unsubscribe.
- Emails are sent through a platform owned by the Organiser’s corporate group, with servers located within the European Union. Data are not disclosed to third parties for their own purposes.
- You can unsubscribe from the newsletter using the link in every email. You can exercise your rights of access, rectification, erasure, objection, restriction and portability as explained in the Privacy Policy, and you may lodge a complaint with the Spanish Data Protection Agency (AEPD) or with the supervisory authority of your country of residence.
13. Changes, Cancellation and Fraud
The Organiser may amend these terms for a justified reason or cancel the prize draw in the event of force majeure, giving notice through the same channels in which it was announced. No change may be to the detriment of those who have already entered.
The Organiser may also exclude, without prior notice, any entry in which it detects fraud, abuse or manipulation.
14. Governing Law and Complaints
These terms are governed by Spanish law. Any complaint may be sent to [email protected]. If you are a consumer, the courts of your place of residence, or those determined by the applicable consumer protection rules, will have jurisdiction, and nothing in these terms limits that right.
